Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected. Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Septic Tank Pumping Service Terms

Service Scheduling

Evans Septic Pumping & Excavating will make reasonable efforts to schedule septic tank pumping services at the time agreed upon during booking. Scheduling is subject to availability and may be affected by weather, road conditions, equipment status, or other operational factors. Evans Septic Pumping & Excavating will notify customers of any significant scheduling changes as promptly as possible. For emergency service requests outside of normal business hours, Evans Septic Pumping & Excavating will make reasonable efforts to respond, but cannot guarantee specific response times.

Site Access Requirements

The customer is responsible for ensuring that the septic tank access point (lid or risers) is locatable and accessible on the scheduled service date. Tanks covered by soil, landscaping, decks, or other structures may require additional locating or excavation time and will incur additional fees as outlined below. Driveways, gates, and approach routes must be clear and capable of supporting a service vehicle, which can weigh in excess of 30,000 pounds when loaded. Animals must be secured and the service area must be safely accessible to our technicians.

Acceptable Service Conditions

Evans Septic Pumping & Excavating reserves the right to decline or postpone service if site conditions are deemed unsafe or unsuitable for service vehicle operation. This includes but is not limited to flooding, saturated ground that cannot support a service truck, hazardous materials near the tank, severe weather, or inability to locate the tank access point. Any rescheduling required due to these conditions may result in a trip charge or rescheduling fee.

Waste Composition and Hazardous Materials

Standard septic pumping covers domestic wastewater and organic solids. If Evans Septic Pumping & Excavating identifies the presence of hazardous substances in your tank during inspection or pumping, including industrial chemicals, solvents, paint, fuel, pesticides, or other materials prohibited by the receiving treatment facility, Evans Septic Pumping & Excavating reserves the right to refuse the pump-out or to charge additional disposal fees as required by the facility. The customer is responsible for any surcharges imposed by the disposal facility for non-compliant waste. All septic waste pumped by Evans Septic Pumping & Excavating is transported and disposed of at permitted facilities in accordance with applicable local, state, and federal regulations.

Service Scope and Service Report

Standard septic pumping service includes locating accessible tank lids (where locating is included in the quoted price), removal of liquid and solid waste from the tank, and a visual inspection of the tank interior to the extent visible during pumping. Upon completion, customers will receive a service ticket documenting the date of service, approximate volume pumped, and any observed tank conditions, including notes on baffle condition, tank integrity, and recommended follow-up where applicable.

Standard pumping does not include camera inspections, drain field evaluation, baffle or riser repair, tank repair, lid replacement, or any work beyond what is required to safely pump the tank. These services are available separately and will be quoted independently.

Property Access and Incidental Damage

Service vehicles are heavy and septic pumping involves accessing portions of the property that may include lawns, driveways, gravel surfaces, or landscaped areas. Evans Septic Pumping & Excavating takes reasonable precautions to minimize disturbance, but the customer acknowledges that incidental impressions, minor turf damage, or marks on driveways may occur as a normal consequence of service vehicle access. Evans Septic Pumping & Excavating is not responsible for incidental damage to lawns, driveways, sprinkler systems, invisible fencing, septic system components that are not properly marked, or other underground or unmarked features. Customers who wish to mark or flag any such features prior to the service date are encouraged to do so.

Service Interval Recommendations

Evans Septic Pumping & Excavating may provide a recommended interval for next service based on tank size, household occupancy, observed sludge and scum levels, and applicable local regulations. Typical service intervals for residential systems are every three to five years. These recommendations are advisory; the customer is responsible for scheduling future service in accordance with their own assessment and any applicable local permit or maintenance requirements.

Extra Fees and Charges

Additional charges may apply for the following:

  • Tanks requiring locating or excavation of buried lids
  • Tanks larger than the standard residential size quoted at booking
  • Excessive sludge buildup, root intrusion, or compacted solids requiring additional pumping time or water-jetting
  • Trip charges for inaccessible, unsafe, or otherwise non-serviceable sites
  • Rescheduling on short notice
  • Emergency or after-hours service requests
  • Disposal surcharges where waste composition requires special handling

All additional charges will be communicated to the customer prior to performing the additional work wherever practical, and invoiced according to the terms provided by Evans Septic Pumping & Excavating.

Payment

Unless otherwise agreed in writing, payment is due upon completion of service. Evans Septic Pumping & Excavating accepts the payment methods communicated at the time of booking. Disputed charges should be raised with Evans Septic Pumping & Excavating within a reasonable time after service so that they can be reviewed against the service ticket and any technician notes.

Customer Acknowledgment

By scheduling septic pumping service with Evans Septic Pumping & Excavating, the customer acknowledges that they have read, understood, and agreed to these specific service terms in addition to the general Terms and Conditions provided on this website. In cases of high demand, scheduling conflicts, or service availability, Evans Septic Pumping & Excavating reserves the right to subcontract or coordinate service fulfillment through a trusted third-party provider. Non-compliance with these terms may result in service refusal, rescheduling, or additional charges.

Service Fulfillment and Third-Party Providers

Due to capacity constraints, scheduling conflicts, or service availability, Evans Septic Pumping & Excavating may connect customers with independent third-party septic service providers to fulfill service requests. When this occurs, the third-party provider is an independent contractor and not an employee or agent of Evans Septic Pumping & Excavating. The customer is responsible for verifying that any provider hired holds the necessary licenses, insurance, and permits required for the work being performed in their jurisdiction.

This site is a free service to assist homeowners in connecting with local service contractors. All contractors are independent and this site does not warrant or guarantee any work performed. It is the responsibility of the homeowner to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed. All persons depicted in a photo or video are actors or models and not contractors listed on this site.
